update chart legend symbol to match symbol edited by format data point

below is a X Y scatter I am using to illustrate positional difference in hole position of 2 different parts to visually link Suspect part data with Other lot sample data in the actual data points I am using Color you can see i went into the data point itself and altered the marker options to achieve this.

I was not expecting the legend to not update the marker changes. How do you accomplish this with out making custom shapes to put over the chart? I read in 2016 version there isn't a way but we are using Excel 365 MSO (v 2210) which I believe is a later version than 2016 so i assume this was fixed?
