Custom Theme switches back to Default when file is emailed Excel 2010

I have created a custom theme and for some reason when I send the file to someone who doesn't have it the theme reverts to the default. I never had this problem with 2007 and only recently switched to 2010.

Is it a setting in office 2010 that I can change?
