Copying merged cells in Protected sheet w/ VBA

I currently have a macro that if initiated copies a new table into a protected worksheet.

the blank cells in the receiving worksheet are not protected, so that it can receive it
when protecting the worksheet, I allow for copied cells and format changes

For some reason, it will not copy over the merged cells correctly when the sheet is protected.
If the sheet it not protected, it copies the merged cells just fine.
This is the same result when using the macro or doing it manual, so the issue is when the sheet is locked.

Below are the sheet protections.... Any ideas?

using merged cells is bad practice. Nothing but trouble ...

Not sure how you are using merged cells, but if just merging multiple columns single rows, you can get the same visual effect without all the issues caused by Merged Cells (which cause issues for a whole bunch of things like VBA and sorting, among other things), by using the "Center Across Selection" formatting option instead.
