Conditional Formatting does not match error

Hello

This should be a simple one but I just can't get it to work. I opened a new workbook and simplified the data to check that I could get the formatting working on anything for a start. This is the simplified version..

A B
1 Z Z
2 Y Y
3 Z Y


I have put the conditional formatting rule

Formula: ="$A1<>$B1" (fill yellow) Applies to: =$B:$B

Cell B3 should highlight, I see no reason why this shouldn't work but it's stumping me.
